How to file an appeal for disability in New Hampshire?

If your Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) claim has been denied in New Hampshire, you still have options. The Social Security Administration (SSA) allows you to appeal the decision through several structured steps. Filing an appeal promptly and correctly can significantly improve your chances of receiving benefits.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Step 1: Understand Why You Were Denied

Before beginning your appeal, carefully review the denial letter from the SSA. It will include the reasons for denial and instructions on how to appeal. Common reasons include:

  • Lack of sufficient medical evidence
  • Earning above the Substantial Gainful Activity (SGA) limit
  • Failure to follow prescribed treatment
  • Incomplete or inaccurate application

Understanding the denial reason helps you build a stronger case during appeal.

Step 2: File a Request for Reconsideration

This is the first level of appeal. You must request reconsideration within 60 days of receiving your denial notice.

  • How to File:
  • Online at www.ssa.gov
  • By phone: 1-800-772-1213
  • At your local SSA office

During reconsideration, a different SSA reviewer will examine your case. You should submit any new medical evidence or documents to strengthen your appeal.

Step 3: Request a Hearing with an Administrative Law Judge (ALJ)

If your reconsideration is denied, you can request a hearing before an ALJ. This step allows you to explain your case in person (or via video) and present witnesses or expert testimony.

  • How to Request a Hearing:
  • Submit the request online or through your local SSA office within 60 days of the reconsideration denial.
  • Prepare Your Case:
  • Bring updated medical records, physician letters, and supporting evidence.
  • Be ready to answer questions about how your condition impacts your ability to work.

Step 4: Appeals Council Review (if needed)

If the ALJ denies your claim, you can request a review by the SSA’s Appeals Council. They may:

  • Approve your claim
  • Send it back to the ALJ for another hearing
  • Deny your request

Step 5: File a Federal Lawsuit

If all previous appeals are denied, your final option is to file a lawsuit in federal district court. This step is complex and generally requires legal representation.
